§1

Privacy Policy

§1.1 Data Controller. WebPatternNetwork, registered at Calle de Yecla, 2, 28022 Madrid, Madrid, Spain, is the data controller for all personal information processed through this platform. Contact: [email protected].

§1.2 Categories of Data Collected. We collect the following categories of personal data: (a) identification data including name and email address; (b) contact data including telephone number; (c) professional data including company name and role; (d) technical data including IP address, browser type, and session telemetry.

§1.3 Purpose of Processing. Personal data is processed exclusively for: (a) responding to project inquiries and delivering technical proposals; (b) executing contractual obligations under signed Statements of Work; (c) complying with statutory tax and accounting obligations; (d) ensuring platform security and preventing fraudulent access.

§1.4 Legal Basis. Processing is conducted under GDPR Article 6(1)(b) (contractual necessity) and Article 6(1)(f) (legitimate interest in service delivery and security). For CCPA-covered residents, we do not sell personal information as defined under Cal. Civ. Code §1798.140(v).

§1.5 Data Retention. Personal data is retained for the duration necessary to fulfill the stated purposes: (a) project inquiry data: 24 months from last contact; (b) contractual data: 5 years from contract termination as required by Spanish commercial law; (c) technical telemetry: 12 months in aggregated form.

§1.6 Data Security. All personal data is stored within encrypted EU-hosted cloud infrastructure compliant with ISO/IEC 27001 standards. We implement TLS 1.3 encryption in transit, AES-256 encryption at rest, and multi-factor authentication for all administrative access.

§1.7 Third-Party Sharing. We do not sell, rent, or distribute personal information to unauthorized third-party brokers. Data may be shared with: (a) cloud infrastructure providers operating under EU-approved Standard Contractual Clauses; (b) payment processors for transactional purposes; (c) legal authorities when required by applicable law.

§1.8 Data Subject Rights. Under GDPR, you have the right to: access your data (Art. 15), rectify inaccuracies (Art. 16), request erasure (Art. 17), restrict processing (Art. 18), data portability (Art. 20), and object to processing (Art. 21). Under CCPA, California residents have the right to know, delete, and opt out of the sale of personal information. Exercise these rights by contacting [email protected].

§1.9 International Transfers. Where data is transferred outside the EU/EEA, we ensure adequate protection through EU Standard Contractual Clauses or adequacy decisions as recognized by the European Commission.

§2

Terms of Service

§2.1 Scope. These Terms govern all services provided by WebPatternNetwork, registered at Calle de Yecla, 2, 28022 Madrid, Madrid, Spain, including web application development, API pipeline engineering, database architecture, and related consulting services.

§2.2 Engagement Structure. All services are governed by explicitly contracted Statements of Work (SOW) executed between the Client and WebPatternNetwork. Each SOW defines scope, deliverables, timelines, pricing, and acceptance criteria. These Terms supplement but do not replace individual SOW agreements.

§2.3 Pricing & Payment. Pricing is defined in each SOW and published on our configuration manifest. Invoices are due net-15 from issuance. Late payments incur a 1.5% monthly interest charge. All prices are in USD unless otherwise specified.

§2.4 Intellectual Property. Upon complete settlement of all agreed commercial invoices, WebPatternNetwork assigns all worldwide intellectual property rights in client-specific deliverables, source code, design tokens, and digital assets directly to the Client. Pre-existing framework components remain property of WebPatternNetwork under a perpetual, royalty-free license.

§2.5 Delivery & Acceptance. Deliverables are provided in accordance with the timeline specified in each SOW. The Client has 5 business days from delivery to review and provide acceptance or detailed rejection. Failure to respond within this period constitutes acceptance.

§2.6 Confidentiality. Both parties agree to maintain strict confidentiality of proprietary information exchanged during the engagement. This obligation survives termination for a period of 3 years.

§2.7 Limitation of Liability. WebPatternNetwork's total aggregate liability under any SOW shall not exceed the total fees paid by the Client under that SOW. In no event shall WebPatternNetwork be liable for indirect, incidental, or consequential damages.

§2.8 Termination. Either party may terminate a SOW with 30 days written notice. WebPatternNetwork retains the right to payment for all work completed up to the termination date. Materials delivered prior to termination remain subject to the IP assignment provisions of §2.4.

§2.9 Governing Law. These Terms and all SOWs are governed by the laws of Spain and the European Union. Disputes shall be resolved through the competent courts of Madrid, Spain.

§3

Cookie Policy

§3.1 Cookie Usage. WebPatternNetwork uses cookies and similar tracking technologies to ensure secure platform operation, maintain session integrity, and optimize response latency. Cookie consent is obtained through our interactive consent banner.

§3.2 Essential Cookies. These cookies are strictly necessary for platform operation: (a) session cookies for authentication state; (b) CSRF tokens for form security; (c) load balancer affinity cookies for server routing. These cannot be disabled.

§3.3 Analytics Cookies. We use privacy-respecting analytics to measure platform performance: page load times, API response latencies, and error rates. All analytics data is aggregated and anonymized. No personal identifiers are stored in analytics cookies.

§3.4 Preference Cookies. These cookies remember your preferences: language selection, cookie consent state, and display preferences. They are stored in localStorage and persist for 12 months.

§3.5 Cookie Management. You may manage cookies through: (a) our consent banner, accessible at the bottom of every page; (b) your browser settings; (c) by contacting [email protected] for complete data deletion.

§3.6 Third-Party Cookies. We do not deploy third-party advertising or tracking cookies. Embedded content (e.g., Google Maps) may set their own cookies subject to their respective privacy policies.

§4

Refund & Reimbursement Policy

§4.1 Refund Eligibility. WebPatternNetwork offers refunds under the following conditions: (a) if work has not commenced, a full refund minus any administrative fees (10% of deposit) will be issued within 10 business days; (b) if work is partially completed, a pro-rata refund will be calculated based on completed milestones versus remaining deliverables.

§4.2 Non-Refundable Items. The following are non-refundable: (a) completed and accepted deliverables; (b) third-party license fees already procured on behalf of the Client; (c) domain registration or hosting setup fees; (d) consulting hours already delivered and logged.

§4.3 Refund Process. Refund requests must be submitted in writing to [email protected] within 14 days of the invoiced date. Refunds are processed to the original payment method within 10 business days of approval. For disputes, both parties agree to attempt good-faith resolution before pursuing formal proceedings.

§4.4 Subscription & Retainer Refunds. Monthly retainer services may be cancelled with 30 days written notice. The current billing period is non-refundable, but no further charges will be incurred after the cancellation effective date.

§4.5 Governing Standards. This refund policy is subject to Spanish consumer protection law and EU Directive 2011/83/EU on consumer rights. Where local law provides greater consumer protections, those protections shall prevail.
